Terms of Use and Sale
These terms govern Roman Vaxman’s personal garage-sale website and purchases made through it. This is a limited sale of Roman’s personally owned items, not an ongoing retail business.
Listings and availability
Roman aims to describe each item honestly, including its condition, included accessories, known limitations, and any available test results. Some active listings may temporarily say “Photos coming soon”; that notice means photographs are not yet published, not that the listing is a stock-photo representation. Ask any material question before buying. Inventory can change, and an item is not sold until payment is completed and confirmed.
Used items; no manufacturer warranty
Unless a listing expressly says otherwise, items are used and sold as-is. Any remaining manufacturer warranty is not promised to transfer. Buyers should review the listing and ask material questions before purchase. Nothing here excludes rights that cannot legally be waived.
Prices and payment
Prices and offers are in U.S. dollars. Listed prices for shippable items include a packaging allowance but not carrier postage. Local pickup receives a 10% item-price discount, rounded to whole dollars. Carrier postage is added separately when shipping is available. Card payments are processed through Stripe, and Roman absorbs card-processing costs rather than adding a separate card surcharge. A submitted offer is only a proposal: it does not reserve an item or create a sale unless Roman accepts it and payment is completed. Roman may accept, reject, or counter an offer and may correct an obvious pricing, description, or inventory error before completing a transaction.
Checkout and inventory holds
Starting Stripe Checkout temporarily reserves the selected inventory, normally for up to 30 minutes. Leaving Checkout does not complete a purchase. If the Stripe session expires or payment fails, the reservation is released. A purchase is confirmed only after Stripe reports successful payment. If an item cannot be provided because of an inventory or listing error, Roman may cancel the order and refund the amount paid.
Transactional email
By submitting an offer or order, the buyer authorizes transactional email about that request, including offer receipts, payment confirmations, pickup coordination, shipping, tracking, cancellations, and support. These messages are operational rather than marketing email.
Local pickup
Local pickup is available in Southern California. The exact location and time are arranged privately after purchase. Buyers must bring suitable transportation and help for large items. Ownership and risk transfer when the buyer accepts the item at pickup.
Shipping
Shipping is available only when the listing and checkout permit it. Carrier postage is charged separately from the item price. Live shipping requires verified packed dimensions and weight; until those details are available, checkout may require local pickup even for an item that could later become shippable. Oversized, fragile, and no-box items may remain pickup-only. Delivery estimates are carrier estimates, not guarantees. After a paid shipped order, the shipping address and order details needed for fulfillment may be provided to the carrier or shipping-service provider.
Inspection, cancellations, and returns
Pickup buyers may inspect an item before accepting it. Unless required by law or Roman materially misdescribed the item, completed sales are final and change-of-mind returns are not accepted. To request cancellation before pickup or shipment, contact Roman promptly; cancellation is not guaranteed after payment. If an item arrives damaged or materially different from its listing, contact Roman promptly, preserve all packaging, and provide photographs and other reasonable evidence so the issue or a carrier claim can be evaluated. These terms do not waive rights that applicable law does not allow to be waived.
Accounts
Accounts are optional and guest checkout is available. Buyers are responsible for keeping credentials secure and for activity under their accounts. Roman may disable accounts used for fraud, abuse, false orders, or interference with the site.
Site use
Do not probe, scrape at disruptive volume, bypass security, submit false orders, or interfere with other buyers. The site and its content may change or be withdrawn when the sale is complete.
Liability
To the extent allowed by law, Roman is not liable for indirect or consequential losses arising from site use or a used item. Any direct liability is limited to the amount paid for the item giving rise to the claim.
Governing law and contact
California law governs these terms, without regard to conflict-of-law principles. Questions should be sent to [email protected].
